SUMMARY of Community CC&R's 7 RULES APPLICABLE to
ALL HOMEOWNERS, TENANTS & THEIR INVITEES in the RIDGE
1. Authorized & Prohibited Vehicles. 2. Overnight Street Parking. 3. Vehicle Repair. 4. Multiple Family Occupancy. 5. Licensed & Unlicensed Vehicles & Operators. 6. Towing Violating Vehicles. 7. Enforcement Policy & Fine Schedule.

1A. AUTHORIZED VEHICLES. Per CC&R's # 2.5.1, the following vehicles are authorized in the Ridge: Passenger vehicles including automobiles, passenger vans designed to accommodate 10 or fewer people, motorcycles, pickup trucks having a payload capacity of 1 ton or less--provided pickup does not have signage, racks, caution lights, or any other commercial apparatus, equipment or cargo.
1B. PROHIBITED VEHICLES. Per CC&R's # 2.5.2, the following vehicles are prohibited in the Ridge: A) Recreational vehicles (motorhomes, travel trailers, camper vans, boats, etc.). B) Commercial-type vehicles (stake bed trucks, tank trucks, dump trucks, step vans, concrete trucks, limousines & commercial pickups). C) Busses or vans (or any other vehicle) designed to carry more than 10 people. D) Vehicles having more than 2 axles. E) Trailers. F) Inoperable vehicles (or parts of vehicles). G) Aircraft. H) Any vehicle or vehicular equipment deemed a NUISANCE by the Board. I) Any other vehicle not classified as an Authorized vehicle. Prohibited vehicles may not be parked, stored or kept on any public or private street...in, adjacent to, or visible from the properties or any other common area...except for brief periods for loading, unloading, making deliveries, or emergency repairs--not to exceed 24 hours.

2. OVERNIGHT STREET PARKING. A) Per CC&R's # 2.5.3 General Restrictions....all vehicles owned or operated by or under the control of an owner, or a resident of an owner's lot, and kept in the properties, must be parked in the garage of that owner to the extent of the space available; provided that each owner shall ensure that any such garage accommodates at least the number of Authorized vehicles for which it was originally constructed...No vehicle may be left overnight in a street or driveway, except owners (and temporary guests of owners) may park in the owner's driveway if all parking spaces in the garage are occupied by authorized vehicles.
B) Effective 8/15/2003, the Board voided the "No Street Parking Enforcement Moratorium", and per CC&R's 2.5.3, PROHIBITED ALL OVERNIGHT STREET PARKING in the Ridge, and that this be enforced by fines & towing (as soon as posted), with THESE EXCEPTIONS, AS AUTHORIZED BY THE BOARD: i) "Authorized" vehicles only temporarily needing to be parked in the street due to construction.
ii) A reasonable number of "authorized" vehicles of guests may park overnight in the street for no more that 3 consecutive days in any 14 day period. At any time, the Board may revoke this privilege for any lot for excessive parking or abuse.
iii) If authorized by the Board, owners may park an "authorized" vehicle only overnight on the streets, per conditions and according to individual needs and circumstances as determined by the Board.
REQUIREMENTS FOR BOARD PERMISSION TO PARK OVERNIGHT IN THE STREETS:
A) Owner's "Authorized" vehicles must exceed: 1) 3 for 2-car garage lots. 2) 5 for 3-car garage lots.
B) Owner must first fully utilize garage (except for 1 space) and driveway for "Authorized" vehicle parking without parking "Prohibited" vehicle(s) in garage spaces allocated for "Authorized" vehicles, per above, or elsewhere on lot or street..
C) Owners must make written request citing a valid need for overnight street parking to the Board. and submit copies of all registrations pertaining to vehicles at the lot.
D) The request must conform to and recognize that: No lot will be given permission to park more than 1 vehicle in the street! Vehicles cannot extended over the sidewalk, be on landscaped areas, or anywhere on the lot except in the garage or on driveways. (Excess vehicles must be parked outside the Ridge or in storage.)

3. VEHICLE REPAIR. Per # 2.5.3 General Restrictions, repairing, maintaining, restoring
vehicles is prohibited except within an enclosed garage when the garage door is closed, provided such activity is not a business, and does not create noise or a nuisance which
disturbs other residents. (To avoid carbon monoxide or noxious fumes, homeowners are advised to raise the garage door slightly & to leave the side garage door open.)

4. MULTIPLE FAMILY OCCUPANCY. In addition, the Board reminds homeowners that multiple family occupancy & room renting to individuals or groups are prohibited in the Ridge. CC&R's # 2.1 provides that "each lot shall be used as a dwelling for a single family and for no other purpose..." Much of our excessive street parking is due to prohibited multiple family occupancy of houses.

5. LICENSED & UNLICENSED VEHICLES & OPERATORS. The following constitute a nuisance violation (CC&R # 2.3) and are prohibited from operating in the Ridge, as indicated: A) Any unlicensed motorized cycle, vehicle, or operator. B) Any licensed or unlicensed cycle, scooter, bicycle, vehicle, or operator on sidewalks in front of residences, or operating in a noisy or noxious manner within the Ridge.

6. TOWING VIOLATING VEHICLES. Per CC&R # 2.5.4, as soon as signs are posted per VC 22658.2, the Ridge will enforce violations by vehicle removal, as well as with fines, as authorized and as will be posted: "Public parking without permission is prohibited. All vehicles not authorized to park in the Ridge will be removed at the owner's expense. Local traffic law enforcement agency is the CA Highway Patrol. Phone___. A citation may be issued and a fine may be levied for violations."

7) ENFORCEMENT POLICY & VIOLATION FINE SCHEDULE--Effective July 1, 2003. The Ridge Community Association has the right to enforce the Association's
Governing Documents pursuant to the recorded covenants, conditions & restrictions--
CC&R's--and Rules & Regulations--including requesting an owner to cease an offending action, suspending the owner's membership rights, special assessing the owner, fining the owner, and taking legal action against the owner. Owners are responsible for all violations by their family members, tenants, guests, and invitees.
A. Due Process. Per CC # 1363, prior to the imposition of any fine or individual reimbursement assessment, the owner shall be given 10 days notice and an opportunity to appear in person or in writing before the Board of Directors or appropriate committee, and within 15 days after the hearing the owner will be notified in writing of the outcome.
B. Enforcement. Generally, absent special circumstances, the Association will adhere to the following discipline and fine protocol for violations of the Governing Documents:
1. A Warning Notice and request to correct the violation within a reasonable time, as determined by the Board or its committee, will be sent to the owner.
II. A Fine/Hearing Notice will be sent setting forth the violation and requesting immediate remedial action: also establishing a fine amount and setting a hearing regarding the matter at least ten (10) days out. In addition to the fine, the Board or its committee may also assess attorney's fees & costs, if any, associated with the enforcement action. Violations which are remedied in advance of the hearing date may result in the fine(s) being reduced or altogether withdrawn.
III. Note: For subsequent violations of the same type as prior violations, no Warning Notice will be sent to the owner in violation. Instead, the Association will immediately send a Fine/Hearing Notice establishing a fine amount and setting a hearing regarding the violation and fine amount at least ten (10) days from the date appearing on the Fine/Hearing Notice. For subsequent violations of the same type, the Board may assess fines pursuant to the schedules established for second and third violations.
IV. The following fine schedule shall apply to all violations: 1st Violation: $50.00 -$300.00 for initial violation. 2nd Violation: $50.00 - $500.00 for 2nd separate violation. 3rd Violation: $300.00 - $1,000.00 for 3rd separate violation.
NOTE: The Association reserves the right to make any of the above fines a continuing fine to be levied at intervals determined by the Board until the violation is removed. For example, there may be an initial fine of $200.00 and a continuing fine of an additional $200.00 each 30 days until the violation is removed. Additional hearings are not required for the levying of ongoing fines.
